Breakfree 24 hour party Terms and Conditions

These are the terms and conditions (the “terms and conditions”) regulating the attendance and participation in the Organizers twenty-four (24) hour non-stop party (“breakfree”), by you (the “user” or “you”).

 

By clicking on the link provided below, you agree that you have thoroughly read and reviewed these terms and conditions; that you fully understand the same; and that you agree and accept to abide by these legally binding terms and conditions.

Entry/Admittance into the Venue

The Organizers reserve the right to require and electronically verify photographic ID, and to search your person on entry and exit, as conditions of admission.

The Organizers reserve the right to refuse admission to and/or eject any person, appearing to be intoxicated, under the influence of drugs, or otherwise behaving dangerously or inappropriately. You must at all times during the duration of the Party, be in possession of a valid ticket (or any other access paraphernalia) at all times and produce it upon request for inspection at any time. Failure to produce a valid ticket will deny you entry and may result in you being ejected from the venue.

The Organizers reserve the right to request that you leave the venue at any point on reasonable grounds and may take any appropriate action to enforce this right where in the Organizers’ opinion, you;

  • have behaved in a manner which has, or is likely to affect the enjoyment of other attendees; or
  • use threatening, abusive or insulting words or behaviour or in any way provoke or behave in a manner which may provoke a breach of the peace; or
  • are acting under the influence of alcohol or drugs; or
  • fail, when required, to produce proof of identity or age.

 

The Organizers reserve the right to conduct security searches of your person, clothing, bags and all other items on entry and exit and reserves the right to confiscate items which may cause danger or disruption to the event or others. Glass containers, cans, chains and other large, heavy or sharp objects are not allowed at the venue.

Void Tickets/Access Permit

Any Ticket/Access Permit obtained in breach of these Terms and Conditions shall be void and all, rights conferred or evidenced by such Ticket shall be void. Any person seeking to use such a void Ticket in order to gain or provide entry to the venue may be considered to be a trespasser and may be liable to be ejected and liable to legal action.

 

Restrictions, Prohibitions and Undertakings

Save for mobile phones and tablets, the use of other equipment for recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data inside the venue is strictly forbidden. Unauthorized recordings, tapes, films or similar items may be confiscated and destroyed. Any recording made of the event in breach of these conditions shall belong to the Etisalat Nigeria. The Organizers SHALL not be liable for any loss, theft or damage to confiscated items.

You are responsible for your belongings and personal effects at the venue. The Organizers accept no responsibility for the loss, theft and/or destruction of any personal property brought to or purchased at the venue.

Food and drink purchased elsewhere shall not be consumed at the venue, and will be confiscated on entry.

Pets are not allowed at the venue.

To the fullest extent permitted by law, we do not accept liability of any nature for the acts, omissions or default of those providing services in connection with the event or any liability for any injury, damage, loss, delay or additional expenses which are incurred at or in association with this event.

We reserve the right to cancel or postpone the event for any reason.

We may need to collect and keep your personal information including but not limited to your name, address, credit card or payment details, telephone number and/or email. Unless you tell us otherwise, we may disclose these details to third parties so they can provide you with promotional material about other events or services. We may also need to disclose your personal information as required by law

You hereby expressly grant permission to the Organizers to utilize the your image, likeness, actions and statements in any live or recorded audio, video, film, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event in any medium or context for any purpose, including commercial or promotional purposes, without further authorization or compensation.

You further grant the Organizers the right to use your image/likeness as captured on film, video or any other electronic medium being utilized at the event, and further understand that such images will likely be used to promote future events.

You also give your consent to their appearance in images recorded by any type of medium for subsequent informative, promotional and/or commercial dissemination by the Organizers and authorization for the use thereof. The said images may appear in any medium or format worldwide and indefinitely.

You may only leave and re-enter the venue of the event at the discretion Etisalat Nigeria, otherwise, there may be no re-admission or pass-outs of any kind.

The obstruction of gangways, access-ways, exits, entrances or staircases, congregating in non-designated areas or seeking entry to areas or seats for which you do not have access to, is strictly forbidden.

No distribution of flyers or pamphlets and no soliciting or fundraising of any kind is permitted on the festival grounds, grounds entrances, or parking lots. The recording or photography with a long lens camera, video recording device of any kind, or audio recording device is strictly prohibited without first securing the permission and authorization of Etisalat Nigeria. The Organizers reserve the right to expel from the Festival grounds and confiscate recordings from anyone engaged in these activities without permission. You hereby undertake that deface, destroy, damage alter or adversely interfere with any fixture, or installation within the venue.

Health and Safety

You hereby warrant that you are at least eighteen (18) years old and that you are in good physical and mental health, without any history or symptom of any respiratory disease, cardio-vascular disease, autoimmune disease, or any other disease or ailment that may be exacerbated by any strenuous exertions. You hereby agree to hold the Organizers harmless in the event that you fall ill in the course of participating in the event or for any reason whatsoever in the course of the event.

You hereby undertake to comply with all relevant statutes, safety announcements and Venue regulations whilst attending the Event.

If you have any special requirements or concerns about any special effects which may be featured at the event, prior notice should be provided before the date of the event. Special effects may include, without limitation, sound, audio visual, pyrotechnic effects or lighting effects.

Governing Law and Dispute Resolution

These terms and conditions shall be governed, construed and shall take effect in accordance with the laws of Nigeria.

We/you shall use all reasonable endeavors to settle any dispute or difference of opinion between us, arising from or in connection with these terms and conditions amicably through mutual discussion.

In the event that any dispute arises out of or in relation to this Agreement, which cannot be amicably resolved between the Parties within fifteen (15) days after the occurrence of such dispute, then either Party may refer such dispute to arbitration upon giving the other Party fifteen (15) days written notice.

Both Parties agree that:

  • the arbitration proceedings shall be conducted by a single arbitrator appointed by the Chairman of the Chartered Institute of Arbitrators (UK), Nigeria;
  • the seat of the arbitration shall be Lagos;
  • the arbitral award shall be final and binding on the Parties except in instances of misconduct on the part of the arbitrator or error on the face of the arbitral award;
  • each Party shall be responsible for its share of the arbitration fees in accordance with the applicable rules of arbitration and the Parties shall evenly share the costs of the arbitrator.
